for the WooCommerce Online Shop of NXT Level Nails

1. Scope of Application
These General Terms and Conditions apply to all orders and deliveries made through the WooCommerce online shop of NXT Level Nails at https://nxtlevel-nails.at.
Consumers within the meaning of these Terms and Conditions are natural persons who enter into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.
By placing an order, the customer agrees to these Terms and Conditions.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.
By clicking the “Buy Now”, “Place Order” button or a comparable button, the customer submits a binding offer to purchase the goods contained in the shopping cart.
The purchase contract is only concluded upon order confirmation by email or upon shipment of the goods.
3. Prices and Shipping Costs
All prices are stated in euros and include statutory value-added tax, unless otherwise indicated.
In addition to the stated prices, shipping costs may apply. The applicable shipping costs will be displayed during the ordering process.
4. Payment Terms
Payment is made using the payment methods offered in the online shop.
NXT Level Nails reserves the right to exclude individual payment methods on a case-by-case basis.
The goods remain the property of NXT Level Nails until full payment has been made.
5. Delivery
Delivery is made to the delivery address provided by the customer.
Delivery times are stated in the online shop. Information on delivery times is non-binding unless expressly agreed otherwise.
If an ordered product is not available, the customer will be informed immediately.
6. Right of Withdrawal
Consumers have the statutory right to withdraw from the contract within 14 days without giving reasons.
The withdrawal period is 14 days from the day on which the goods were received by the customer or a designated person.
To exercise the right of withdrawal, the withdrawal must be made by means of a clear declaration by email or post to NXT Level Nails.

7. Warranty
The statutory warranty provisions under Austrian law apply.
Obvious defects should be reported as soon as possible after receipt of the goods.
8. Liability
NXT Level Nails is only liable for damages caused intentionally or through gross negligence.
Liability for slight negligence is excluded to the extent permitted by law.
Liability for damages arising from injury to life, body, or health remains unaffected.
9. Data Protection
The processing of personal data is carried out in accordance with the privacy policy on the website.
Personal data is used exclusively for order processing, delivery, and customer service.
10. Jurisdiction and Applicable Law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law only applies to the extent that it does not restrict any mandatory statutory provisions of the country in which the consumer has their habitual residence.
The place of jurisdiction is—to the extent legally permissible—the registered office of NXT Level Nails.
